Only our general sales conditions are applicable
The acceptance of an order is subject to the approval of the buyer with following conditions :
- The annulment of an agreement is not accepted in case of superior force or an unforeseen delay in the supply of base materials or due to a bad delivery of the supplier of ChristiesCollection. In suchlike circumstances, the buyer isn't entitled to any compensation.
- In accordance with possible restrictions stipulated by the suppliers, ChristiesCollection reserves the right to change prices, reversals of entry and conditions of orders in progress on any given moment without prior notice.
Subject to any other stipulation, these alterations don't open the right for the buyer to annul his outstanding orders. - Under no circumstances the buyer is entitled to annoy his order. The seller always reserves the right to enforce the execution of the contract. In such case and in despite of what mentioned before, the seller is entitled to a fixed and irreducible compensation from the buyer equal to 33 % of the value of the order when he cancels his order or refuses to accept the delivered goods.
- Nevertheless all efforts made by us to ensure a proper delivery, our terms of delivery are only demonstrative. Consequently, a delay in delivery cannot open the right to an annulment or any compensation.
- Each shipment always happens on the buyer's risk, under no circumstances ChristiesCollection can't be held responsible for any delay, shortcoming or damage related to the transport.
In such case the addressee has to have assessed these complaints in writing by the transporter with notification of his reservations and complaints.
This stipulation stays valid, even when the seller has indicated the means of transportation. - Corresponding to the statutory regulations and on penalty of prosecution, it is prohibited to partly or completely reproduce the purchased or observed models,
as well as giving any information to a third party which can lead to the reproduction.
If done so he can be guilty of complicity to the crime of forgery. - All goods well remain the property of the seller until they are fully paid by the buyer.
- All complaints concerning the goods as well as the according invoice, have to be filed within 8 days following the reception.
This term is stipulated on penalty inadmissibility.
The return has to take place after the reception of a return licence. When a complaint proves to be justified the returned goods will be exchanged or, if possible a credit will be given, this without any compensation. - When the buyer proves to be in default on the given expiry date, in case of objection, ChristiesCollection preserves the right for the full amount of the outstanding debts, including those who aren't yet expired, given that the non-payment or the protest invalidates the accorded expiry dates.
10. The failure to pay on the expiry date results legally in an interest due to omission equal to 1,5 % a month, furthermore there will be a fixed and irreducible compensation equal to 15 % of the claimable amount of the concerning account with a minimum of 50 €.
In case of dispute, the jurisdiction will only be granted to the Court of Leuven, Belgium.
